Scope
This Acceptable Use Policy ("AUP") describes activities prohibited when using PINNIQAL. It supplements the Terms of Service and is incorporated by reference. Violations may result in immediate suspension or termination of your account without refund.

Unlawful conduct
You may not use PINNIQAL to engage in, facilitate, or assist with:
– Activity that violates any applicable law, regulation, or court order, including consumer-protection, anti-spam, anti-fraud, anti-money-laundering, sanctions, export-control, or telecommunications laws.
– Processing payments for goods or services that are illegal under U.S. federal law or appear on Stripe's restricted-businesses list.
– Promoting, distributing, or facilitating controlled substances, regulated weapons, sexual exploitation material, illegal gambling, or fraudulent financial products.
Deceptive or abusive communications
You may not:
– Send unsolicited bulk messages or spam to recipients who have not given valid consent (TCPA, CAN-SPAM, CASL, ePrivacy).
– Misrepresent your identity, send on behalf of another business without authorization, or spoof caller ID / sender identifiers.
– Send phishing messages, malware, or links to fraudulent payment pages.
– Harass, threaten, intimidate, or coerce any recipient.
Marketing SMS — specific rules
A message is "marketing SMS" if it advertises, promotes, or encourages the purchase of goods or services, or otherwise constitutes a "telephone solicitation" under the TCPA. Purely transactional messages (appointment reminders, two-factor codes, payment receipts, order updates) are subject to different rules; when in doubt, treat as marketing.
– Obtain valid prior express written consent from each recipient before sending.
– Marketing SMS may only be sent 8am–9pm in the recipient's local time. PINNIQAL enforces a 9am–7pm window in the operator's time zone as a safe buffer.
– Every marketing SMS must include opt-out instructions. PINNIQAL auto-appends "Reply STOP to opt out" if your message body does not already include "STOP".
– Honor STOP / UNSUBSCRIBE requests immediately and indefinitely.
– High-volume US SMS requires Twilio A2P 10DLC brand + campaign registration; PINNIQAL facilitates submission but the underlying brand and campaign are yours.
– Recipient phone numbers must be obtained directly from the recipient or through a clearly disclosed lawful channel.
Email marketing
Comply with CAN-SPAM (US), CASL (Canada), GDPR (EEA), and other applicable email-marketing laws, including disclosure of a physical business address and a functioning unsubscribe mechanism in every commercial email. Use only sending inboxes you are authorized to send from.
Security
– Do not probe, scan, penetration-test, or otherwise test the security of PINNIQAL infrastructure without prior written authorization. To report a vulnerability, see /.well-known/security.txt or email security@pinniqal.com.
– Do not circumvent rate limits, daily caps, captcha, or other anti-abuse controls.
– Do not upload malware, viruses, ransomware, or otherwise interfere with the integrity of the Service or other users' workspaces.
Misuse of AI features
You may not use PINNIQAL AI features to generate content that:
– Is intended to deceive, harass, defame, or impersonate any individual.
– Is sexually explicit content involving minors or any non-consensual sexual content.
– Incites violence or hatred against a protected class.
– Substitutes for required human review (e.g., regulated communications in healthcare, financial, or legal contexts without qualified human oversight).
Account and platform abuse
– Reselling PINNIQAL to third parties outside an agency or white-label arrangement signed with us.
– Using PINNIQAL to build, train, or evaluate a competing product.
– Sharing login credentials outside your Authorized Users.
– Creating multiple accounts to evade suspensions or limits.
Reporting abuse
If you believe a PINNIQAL user is violating this AUP, report it to abuse@pinniqal.com with as much detail as you can share (offending phone number or email, sample message content, timestamps, screenshots, your contact). We investigate every report and aim to acknowledge within 2 business days and act within 5 business days where action is warranted.
Recipients of messages they believe violate this AUP may also report to abuse@pinniqal.com.
Enforcement
We may, at our discretion and without prior notice when circumstances warrant:
– Issue a written warning.
– Throttle, restrict, or remove specific features.
– Suspend the offending workspace temporarily.
– Terminate the account permanently.
– Disclose information to carriers, law enforcement, or other authorities as required by law or reasonably necessary to prevent harm.
Egregious violations — TCPA mass-spam campaigns, fraud, abuse of minors, or violations that put our carrier relationships at risk — may result in immediate termination without refund and may be reported to law enforcement.
Appeals
If you believe your account has been suspended or terminated in error, email legal@pinniqal.com within 14 days of the action. Include your workspace identifier, a description of the activity, and any evidence. We will review and respond within 10 business days; where practicable, the reviewing decision-maker will not be the person who imposed the original action.
Appeals do not stay enforcement: account access is not restored during review unless we determine continued suspension would cause clearly disproportionate harm.
Changes
We may update this AUP from time to time. Material changes will be announced by email to active customers at least 30 days before they take effect, except where a change is required for an immediate legal, security, or carrier-compliance issue.
